This depends on the nature of the agreement you entered into with her when she started work at your salon. If there was a written contract with her when you took her on you need to look at the terms and conditions and see if she in breach of any restrictive covenants or terms. For example, is she restricted from practising as a hairdresser within a half-mile radius? If so, you could take injunction proceedings against her but the court would consider various factors including the reasonableness of the contract term, the issues of restraint of trade and the affect on your ex-employer’s working life.

You also need to consider the costs involved in taking court proceedings and whether it would be a waste of money. Without any written terms between you, you will find it difficult to have any legal grounds against her unless you can prove there was a verbal agreement between you. However, it is worth talking to her and seeing if you can come to a compromise to avoid the risk of court action against her.
