Under the new Tier Rules an extension application requirement is that "a person must have or have last been granted leave in a certain immigration category." This therefore allows for out of time applications to be made in these ctaegories. Neverthless your application has been refused and the only way to challenge this decision is by way of appeal. The question is whether you have a right of appeal which is unlikely since you submitted your application after your previous leave expired. If you would like any further advice as to any further options please do not hesitate to contact me.

Further to the above, please note that applications are likely to be refused by the UKBA if made more then 28 days after leave expiring.
