Immigration question:

hello, I am in the UK since 2006 and have a child of 9 months with a partner, He is on PSW. I applied for my student visa extension last year and was refused. I appealed and won my case. The First T Tribunal Judge gave his decision that even if Home Office do not consider my case on Tier 4 ground, my appeal is allowed on Article 8 grounds. Home Office repealed in Crown Court and once again I won the case and The Crown Court maintained that even if home office dont consider my application on Tier 4 grounds, still my appeal will be allowed on Human Rights (article 8) grounds. Now I am applying for asylum on basis of my religion ( my partner and son will be my dependents in asylum application). What are the chances of considering the Article 8 grounds if my asylum is not considered under Geneva Convention?
